B&B Hotels Germany GmbH (hereinafter also “B&B HOTELS”, “we”, “us” or “our”) offers customers (hereinafter also “you”, “you”, “your”) the opportunity to order various products via the online store on the website https://www.hotel-bb.com/gutscheine (hereinafter the “Online Shop”). This option is only offered to consumers who are at least 18 years old and resident in Germany. The customer is a consumer insofar as he orders for purposes that cannot be attributed primarily to his commercial or independent professional activity. These General Terms and Conditions of Sale (hereinafter referred to as “Terms and Conditions of Sale”) apply to all purchases of products via the online store.

1.1 Your order will be executed in accordance with our terms and conditions of sale valid at the time of ordering. You can find our Terms and Conditions of Sale in the online store under the heading GTCS. In addition, the terms and conditions of sale will be sent to you by e-mail following your order.
2.2 The customer can select products in the online store and place them in the virtual shopping cart. The products selected by the customer are displayed in the shopping cart.
2.3 Clicking on the “Continue” button takes you to the next order step, where you must enter your details. Here you can enter a delivery address and select the payment method. Your order cannot be completed without entering a valid e-mail address.
2.4 You can pay by credit card (VISA, American Express, MasterCard) and PayPal.
2.5 In the next step, you will be given the opportunity to check, change and/or correct your order
2.6 By clicking the button “Order with obligation to pay”, the customer submits a binding offer to order the goods displayed.
2.7 When paying by credit card, payment instructions are issued when the customer submits a binding offer to place an order. In the case of payment by PayPal, the customer will be forwarded directly to the payment service provider's website after submitting a binding offer and asked to complete the information for the payment amount.
2.8 The purchase contract is concluded when we accept the customer's offer. In the case of vouchers, this is done by making the voucher available for printing in the online store immediately after the customer has placed a binding order. In the case of all other products, we accept the customer's offer by sending an order confirmation.
2.9 The customer receives the order confirmation by e-mail immediately after placing his order. The order confirmation contains the contract details including the invoice and these Terms and Conditions of Sale.
2.10 Vouchers are provided to the customer exclusively in digital form. They can be printed out directly from the website of the online store after placing the order and are also sent by e-mail. All other products are sent to the customer by parcel (UPS). We will confirm the shipment to the customer by e-mail. Only one parcel is sent per order.
2.11 You will only receive an invoice in digital form. We will send this to you by email with the order confirmation. Customer orders and the details of the contract are stored by us. We will make the contract documents available by e-mail on request in the event of loss.
3.2 Delivery and packaging costs are added in accordance with our current shipping costs table. This can be called up under shipping costs.
4.2 When paying by PayPal, the customer is forwarded to the PayPal website after submitting a binding offer to place an order by clicking on the “Order with obligation to pay” button and completes the information for the payment instruction there.
4.3 In the case of purchase by credit card, your credit card account will be debited immediately after placing the order.
5.2 The delivery of other products takes place within Germany within five working days after conclusion of the contract. Delivery outside of Germany does not take place. If the delivery deadline is exceeded, you can set us a reasonable grace period to deliver the goods. If this grace period expires without success, the buyer is entitled to withdraw from the purchase contract.
5.3 If we are not supplied correctly and/or on time by our suppliers, we shall inform you of this as soon as possible and expressly reserve the right to withdraw from the purchase contract. Withdrawal shall only take place in the event that we have concluded a congruent hedging transaction with our supplier and we are not responsible for the non-delivery. In the event of withdrawal, we will immediately refund the corresponding purchase price.
5.4 Further legal claims of the customer remain unaffected.
6.2 Vouchers can only be issued as vouchers for a fixed amount.
6.3 You can redeem the vouchers for overnight stays in our hotels within Germany, Austria and the Netherlands. Redemption for overnight stays in other B&B HOTELS Group hotels in other European or non-European countries is excluded.
6.4 A redemption is possible for the price of the overnight stay as well as all other hotel services (e.g. breakfast or parking, if subject to a charge). Any taxes incurred on the overnight stay (e.g. tourism tax) can also be paid with the voucher. Redemption for merchandise products is excluded.
6.5 The voucher can only be redeemed online via the B&B HOTELS booking portal at https://www.hotel-bb.com or via the B&B HOTELS apps operated by B&B HOTELS. You will need the voucher code on the voucher to redeem it.
6.6 When redeeming a voucher, you can use the online check-in option before your arrival if you have already specified the voucher as a means of payment when booking the hotel room.
6.7 If the amount of the voucher is not fully utilized when redeemed, the respective difference remains and can be redeemed in accordance with sections 6.3 - 6.5 until the expiry date. If the amount of a voucher is not sufficient for the booking or the conclusion of the accommodation contract, the difference can be settled using the payment options offered.
6.8 Cash payment of the voucher amount is excluded.
6.9 The vouchers are redeemable three years after the end of the year in which the voucher was issued (according to the date of issue shown on the voucher) (expiry date).
10.2 Contracts are concluded in German via our online store.
10.3 The EU Commission has created an internet platform for the settlement of disputes between traders and consumers (ODR platform). The ODR platform is available at the following link: https://ec.europa.eu/consumers/odr/. We are not obliged to participate in an alternative dispute resolution procedure and we do not currently participate in alternative dispute resolution procedures before dispute resolution bodies.

3 Prices and shipping costs

4 Payment methods and terms of payment
4.1 The customer can choose to pay by credit card (VISA, American Express, MasterCard) or PayPal. 4.3 In the case of purchase by credit card, your credit card account will be debited immediately after placing the order.
5 Delivery time and delivery conditions
5.1 Vouchers will be made available for printing immediately after ordering in the online store and delivered to the e-mail address you have provided within 24 hours of conclusion of the contract.5.2 The delivery of other products takes place within Germany within five working days after conclusion of the contract. Delivery outside of Germany does not take place. If the delivery deadline is exceeded, you can set us a reasonable grace period to deliver the goods. 7 Warranty rights

8.1 Cancellation policy| Right of withdrawal You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the last goods. You can use the attached sample withdrawal form, but this is not mandatory. To meet the withdrawal deadline, it is sufficient for you to send your notification of exercising your right of withdrawal before the withdrawal period has expired. Consequences of withdrawal If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this repayment. We may withhold the refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earliest. You must return or hand over the goods immediately and in any case within fourteen days at the latest from the day on which you inform us of the revocation of this contract to Hess & Co. GmbH, Borsigstraße 1, 63110 Rodgau, Germany, without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send the goods before the period of fourteen days has expired. You shall bear the direct costs of returning the goods.
