B&B Hotels Germany GmbH (hereinafter also referred to as "B&B", "we", "us" or "our") offers customers (hereinafter also referred to as "you", "you", "your") the opportunity to order various products via the online shop on the website https://www.hotel-bb.com/gutscheine (hereinafter the "Online Shop"). This option is only offered to consumers who are at least 18 years old and reside in Germany. The customer is a consumer insofar as he orders for purposes that can predominantly be attributed neither to his commercial nor to his independent professional activity. These General Terms and Conditions of Sale (hereinafter referred to as "Terms and Conditions of Sale") apply to all purchases of products via the online shop.

1.1 Your order will be executed according to our terms and conditions of sale valid at the time of the order. You will find our terms and conditions of sale in the online shop under the heading AVB. In addition, the terms and conditions of sale will be sent to you by e-mail after you have placed your order.
2 Offer and conclusion of contract
2.1 Various products are offered to the customer in the online shop. These offers represent a non-binding invitation on our part to purchase products.
2.2 The customer can select products in the online shop and place them in the virtual shopping basket. The products selected by the customer are displayed in the shopping basket.
2.3 Clicking the "Continue" button takes you to the next ordering step, where you must enter your data. Here you can enter a delivery address and select the payment method. Your order cannot be completed without entering a valid e-mail address.
2.4 Payment by credit card (VISA, American Express, MasterCard) and PayPal are available as payment methods.
2.5 In the next step, you will be given the opportunity to check, change and/or correct your order.
2.6 By clicking the button "Order subject to payment", the customer submits a binding offer to order the displayed goods.
2.7 The instruction to pay takes place in the case of payment by credit card with the submission of a binding offer to order by the customer. In the case of payment by PayPal, the customer is forwarded directly to the page of the payment service provider after submitting a binding offer and is asked to complete the information for the instruction of the payment amount.
2.8 The purchase contract is concluded when we accept the customer's offer. In the case of vouchers, this occurs by making the voucher available for printing in the online shop immediately after the customer has placed a binding order. In the case of all other products, we accept the customer's offer by sending an order confirmation.
2.9 The customer receives the order confirmation by e-mail immediately after placing his order. The order confirmation shall contain the contract details including the invoice as well as these Terms and Conditions of Sale.
2.10 Vouchers are provided to the customer exclusively in digital form. They can be printed directly from the website of the online shop after the order has been placed and will also be sent by e-mail. All other products will be sent to the customer by parcel (UPS). We will confirm the shipment to the customer by e-mail. Only one package will be sent per order.
2.11 You will receive an invoice exclusively in digital form. We will send this to you by e-mail with the order confirmation. Orders placed by the customer and the details of the contract are stored by us. We will make the contract documents available by e-mail on request in the event of loss.
3. prices and shipping costs
3.1 Our current prices stated at the time of the order shall apply. All prices stated are in euros and include the statutory value added tax.
3.2 Delivery and packaging costs shall be added in accordance with our current shipping costs table. This can be called up under shipping costs.
4 Payment methods and terms of payment
4.1 The customer may choose to pay by credit card (VISA, American Express, MasterCard) or PayPal. The purchase price is due immediately after conclusion of the contract.

5 Delivery time and delivery conditions
5.1 Vouchers will be made available for printing in the online shop immediately after the order has been placed and will be delivered to the e-mail address provided by you within 24 hours of the conclusion of the contract.
5.2 Delivery of other products will take place within Germany within five working days after conclusion of the contract. Delivery outside Germany will not take place. If the delivery period is exceeded, you may set us a reasonable grace period for delivery of the goods. If this period of grace has expired unsuccessfully, the buyer is entitled to withdraw from the purchase contract.
5.3 In the event that we are not supplied correctly and/or on time by our suppliers, we shall inform you of this as soon as possible and expressly reserve the right to withdraw from the purchase contract. Withdrawal shall only take place in the event that we had concluded a congruent covering transaction with our supplier and the non-delivery is not our responsibility. In the event of a withdrawal, we shall immediately refund the corresponding purchase price.
5.4 Further legal claims of the customer remain unaffected.
6. voucher conditions
6.1 Vouchers are issued by B&B Hotels Germany GmbH.
6.2 Vouchers can only be issued as value vouchers for a fixed amount.
6.3 Vouchers can be redeemed for overnight stays in B&B Hotels within Germany and Austria. Redemption for overnight stays in other hotels of the B&B Group in European or non-European countries is excluded.
6.4 Redemption is possible for the price of the overnight stay as well as all other hotel services (e.g. breakfast or parking, if subject to charges). Any taxes due on the overnight stay (e.g. tourism tax) can also be paid with the voucher. Redemption for merchandise products is excluded.
6.5 The voucher can be redeemed directly at the B&B hotel in Germany, online via the B&B booking portal at https://www.hotel-bb.com or via the B&B HOTELS Apps operated by B&B. You will need the voucher code on the value voucher to redeem it.
6.6 When redeeming a voucher, you can use the online check-in option before your arrival if you have already specified the voucher as a means of payment when reserving the hotel room. If you have not yet selected a payment method when making your reservation and wish to pay for the overnight stay with a voucher, online check-in is not possible. In this case, you can redeem your voucher directly at your selected B&B hotel and then check in on site.
6.7 If the amount of the voucher is not fully used when redeemed, the respective difference remains and can be redeemed until the expiry date in accordance with sections 6.3 - 6.5. If the amount of a voucher is not sufficient for the booking or the conclusion of the accommodation contract, the difference can be made up with the respective payment options offered.
6.8 A cash payment of the voucher amount is excluded.
6.9 The vouchers are redeemable three years after the end of the year in which the voucher was issued (according to the date of issue shown on the voucher) (expiration date).

You have the right to cancel this contract within fourteen days without giving any reason.

To comply with the withdrawal period, it is sufficient for you to send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.
Consequences of the revocation
If you withdraw from this contract, we must refund all payments we have received from you, including delivery costs (with the exception of additional costs resulting from the fact that you have chosen a type of delivery other than the cheapest standard delivery offered by us), without delay and at the latest within fourteen days of the day on which we received notification of your withdrawal from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged for this repayment. We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier. You must return the goods immediately and in any case no later than fourteen days from the day on which you notify us of the cancellation of this contract to Hess & Co. GmbH, Borsigstraße 1, 63110 Rodgau. The deadline is met if you send the goods before the expiry of the period of fourteen days. You shall bear the direct costs of returning the goods. You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking the condition, properties and functioning of the goods.
The right of withdrawal expires prematurely in the case of contracts
- for the delivery of sealed goods which are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery;
- for the delivery of audio or video recordings or software (such as PC and video games) in a sealed package if the seal has been removed after delivery.

10 Miscellaneous:
10.1 The law of the Federal Republic of Germany shall apply to all disputes arising from or on the basis of this agreement, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG).
10.2 Contracts can only be concluded in German via our online shop.
10.3 The EU Commission has created an internet platform for the settlement of disputes between traders and consumers (ODR platform). The ODR platform is available at the following link: http://ec.europa.eu/consumers/odr/. We are not obliged to participate in an alternative dispute resolution procedure and we do not currently participate in alternative dispute resolution procedures before dispute resolution bodies.
